SERVICE TERMS OF FOLLOWMME:
Followmme is an application developed for Android and iOS platforms and aims to connect people by enabling the creation of social events.
We do not charge any amount for you to use Followmme and you will not be shown any advertisement. The application does not use your personal data for this same purpose.
1. THE SERVICES PROVIDED:
Among the resources provided are:
- Create new events and participate in other people's events: you can create a new event, public or private, with a theme of your choice (provided the content respects the commitments mentioned in "YOUR COMMITMENTS WHEN USING FOLLOWMME", described more below). In addition, you can also participate in events that other people have created.
- Customize the content shown to you based on your geolocation: the app uses your device's precise and approximate geolocation so that you can customize the content shown to you. This means that you will preferably be shown events that are closer to your current location, considering the distance radius defined for content filtering.
- Interaction with other users of the application from anywhere in the world: with text chat, you can interact with other users of Followmme through a private conversation or through an event conversation. An event conversation can include two or more users who participate in the same event.
- Combat harmful conduct and content: it is our responsibility to ensure that Followmme users feel safe and comfortable using our application. For this to be done, any harmful conduct and/or content of other user(s) that we become aware of will receive appropriate measures so that they do not occur again. Such measures include: the permanent deletion of published content and the banning or deletion of the user's account who acted in harmful conduct.
2. YOUR COMMITMENTS WHEN USING FOLLOWMME:
To use Followmme features, you must commit to doing your part and follow the rules below:
2.1 YOU CAN ONLY USE FOLLOWMME IF:
- Use the same name you use in your everyday life.
- Provide accurate information about you.
- Create only one account (your own).
- Refrain from sharing your password, giving access to your Followmme account to third parties or transferring your account to someone else (without our permission).
2.2 YOU MAY NOT USE FOLLOWMME IF:
- You are under the age of 13 (or below the minimum legal age in your country to use the app).
- You have been convicted of a sex crime.
- We have previously deactivated your account for violations of our Terms or Policies.
- You are prohibited from accessing the application.
2.3 YOU MAY NOT POST CONTENT THAT:
- Violate the application's Terms of Service;
- Is illegal, misleading, discriminatory or fraudulent;
- Contains sexual and/or violent content;
- Infringes the rights of others, including intellectual property rights.
2.4 IN ADDITION, YOU MAY NOT:
- Upload viruses or malicious code, or do anything that could disable, overload or affect the proper functioning of the application.
- Access or collect data from Followmme using automated means (without our prior permission) or attempt to access data that you are not allowed to access.
By failing to comply with the commitments mentioned above, you will be subject to having your content and account banned and/or deleted. Depending on the case, our team may take legal action against you.
2.5. PERMISSIONS GRANTED TO FOLLOWMME:
2.5.1 PERMISSION TO USE THE CONTENT YOU SHARE:
Content shared or uploaded, such as photos and videos, may be protected by intellectual property laws. You own the intellectual property rights (such as copyrights or trademarks) over the content you create and share on Followmme. Also, nothing in these Terms takes away the rights you have in the content you produce. You are free to share this content with anyone, wherever you want.
However, in order to provide our services, we need you to grant us certain legal permissions (known as a “license”) to use this content. This is solely for the purpose of providing and improving the application and services as described in section 1 above.
Specifically, when you share, post or upload content protected by intellectual property rights on Followmme, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to host, use, distribute, modify, serve, copy, publicly reproduce or display and translate your content, as well as create derivative works thereof, (consistent with your privacy and application settings). This means that you, when, for example, adding a profile picture allows us (again, consistent with your settings) to store and copy that picture and share it with others. This makes the use of Followmme possible and makes it a satisfying experience for you and for all other users.
To remove content individually or all at once, simply delete your account. When you delete content, it will no longer be visible to other users. However, it may continue to exist elsewhere on our systems when:
- Immediate deletion is not possible due to technical limitations (in this case, your content will be deleted within a maximum of 90 days from when you deleted it);
- Your content has been used by others in accordance with this license, and they have not deleted it (in which case the license will continue to apply until that content is deleted);
- Content needs to be analyzed in order to identify illegal activity and/or that violate our terms of use. In this case, the content will be used as evidence and will only be deleted after our analysis and/or after judicial review.
2.5.2 PERMISSION TO UPDATE SOFTWARE YOU USE OR DOWNLOAD:
If you download or use our software, you give us permission to download and install updates to the software when available.
2.6. LIMITS ON THE USE OF OUR INTELLECTUAL PROPERTY:
If you use content protected by intellectual property rights that we own and make available on our app (e.g. images, drawings, videos or sounds provided by us that you add to content you create or share), we will retain all rights to that content. (but not about content owned by you).
If you want to use content owned by us, you must obtain our written permission (or permission under an open source license) to modify, create derivative works from, decompile or otherwise attempt to extract the source code from us.
3. ADDITIONAL PROVISIONS:
3.1 UPDATE OF OUR TERMS:
Followmme is constantly updated, which means that the Terms of Service may change. Therefore, changes to our Terms of Service will be communicated by email and through the application interface at least 7 (seven) days in advance. You will need to accept the new terms before you can continue using the app.
3.2 SUSPENSION OR TERMINATION OF ACCOUNT:
If you violate the Terms of Service, you may have your account suspended or terminated at any time. If your account is suspended, you can contact us and request a review of your case. If it is understood that you have not violated our terms, you may have your account reactivated.
You can request the termination of your account at any time through the application interface. If you choose to do so, your account will be deactivated and will become inaccessible to other users, but will only be permanently deleted after 30 (thirty) days from the date of the termination request. If you try to access your account after making the termination request, it will be reactivated and your request will be cancelled.
3.3 LIMITS OF LIABILITY:
Our team works continuously to provide the best possible experience for our users. However, Followmme is provided “as is”, and we make no guarantee that it will always be safe, error-free, or that it will function without interruptions, delays or imperfections.
To the extent permitted by law, WE ALSO DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not control or direct what people and third parties do or say, and we are not responsible for their conduct (whether online or offline) or any content they share (including content that is offensive, inappropriate, obscene, illegal or objectionable).
We cannot predict the occurrence of problems with Followmme. Therefore, our liability is limited to the maximum extent permitted by applicable law. In addition, we are not liable to you for lost profits, revenue, information or data, or punitive, incidental or indirect damages arising from these Terms.
3.4 CONTESTATION:
We try to provide clear rules in order to limit or even avoid conflicts between you and Followmme. However, if this is unavoidable, it is useful to know in advance where to resolve them and what laws apply. If you are a consumer, the laws of the country in which you reside apply to any claim, cause of action or dispute that you have against us arising out of these Terms.
3.5 OTHERS:
These Terms (formerly known as the Declaration of Rights and Responsibilities) constitute the entire agreement between you and Ludare Tecnologia ltda. onlyabout the use of Followmme. They supersede any previous agreements.
If any part of these Terms is found to be unenforceable, the remaining part will remain in full force and effect. If we fail to enforce any part of these Terms, this will not be considered a waiver. Any changes to or waivers of these Terms must be in writing and signed by us.
You will not transfer any of your rights or obligations under these Terms to any other person without our consent.
These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely transferable by us in the event of a merger, acquisition, sale of assets or by operation of law or otherwise.
You should be aware that we may have to change the username on your account in certain circumstances (for example, if someone else claims such a username and we understand that it has nothing to do with the username you use in your everyday life. ). You will be notified in advance and will receive an explanation of the change if we have to make it.
We always appreciate receiving your feedback and other suggestions about Followmme. But please be aware that we may use them without any restriction or obligation to remunerate you, and we have no duty to keep them confidential.
We reserve all rights not expressly granted to you.
